Welcome to Total Home Protection™

Total Home Protection™ is the flagship whole-home maintenance and repair membership offered by Total Maintenance, Inc. (TMI), a family-owned home services company based in Bettendorf, Iowa, serving the Quad Cities region since 1973. Members receive annual maintenance on their HVAC, water heater, and plumbing systems, parts and labor coverage on covered breakdowns of heating, cooling, plumbing, electrical, and major appliance systems, priority scheduling, and member pricing on repairs — all for a single monthly or annual membership fee. This document is the binding agreement that governs your enrollment. The terms below explain what's included, what's not, how billing and cancellation work, and what to expect when you request service.

This Total Home Protection™ Membership Agreement (the “Agreement”) is entered into between Total Maintenance, Inc. (“TMI,” “we,” “us,” or “our”) and the individual(s) named in the Membership Information Box above (the “Member,” “you,” or “your”). This Agreement establishes your enrollment in the Total Home Protection™ service and maintenance membership program for the residence identified as the Service Address.

As a member, you receive scheduled annual maintenance on your home’s major systems, priority service when things go wrong, member pricing on repairs, and parts and labor benefits on the specific systems and components listed on Schedule A, all subject to the terms below.

By signing below, enrolling online or by phone, or by making your first Membership Fee payment, you agree to all terms of this Agreement, including Schedules A (Included Services), B (Optional Add-Ons), and C (What Is Not Included).

1. Term, Automatic Renewal & Fee Adjustments

1.1  Initial Term. The initial term of this Agreement is twelve (12) months beginning on the Start Date listed above (the “Initial Term”).

1.2  Twelve-Month Commitment. The Initial Term is a binding twelve-month commitment. The annual Membership Fee is fully earned by TMI upon the start of the Initial Term and funds TMI's obligation to maintain, service, and cover your home's systems and appliances over the full 12-month term. Whether you elect monthly billing or annual prepayment, you are obligated to pay the full annual Membership Fee for the Initial Term. Member-initiated cancellation is governed by Section 11 and does not reduce, excuse, or refund the full-term obligation except as expressly provided in Section 11.1 (Cooling-Off Period).

1.3  Automatic Renewal. At the end of the Initial Term and each successive Renewal Term, this Agreement will automatically renew for an additional twelve (12) month term (each a “Renewal Term”) at the then-current Membership Fee and under the then-current terms, without further notice to you and without any action required on your part, unless you opt out of auto-renewal under Section 11.4. Each Renewal Term creates a new 12-month obligation governed by Section 11.2, and the annual Membership Fee for each Renewal Term is fully earned by TMI upon the start of that term. This auto-renewal provision is a material term of this Agreement. By enrolling, you expressly consent to automatic renewal and waive any separate notice of renewal otherwise required by statute, to the extent such waiver is permitted by applicable law.

1.4  Inflationary Fee Adjustment. Membership Fees are subject to periodic adjustment. At the beginning of each Renewal Term, TMI may increase the Membership Fee by an amount not to exceed the greater of (a) the percentage change in the Consumer Price Index for All Urban Consumers, U.S. City Average, All Items (CPI-U), as published by the U.S. Bureau of Labor Statistics over the most recent twelve (12) month period for which data is available, or (b) five percent (5%). Such adjustments reflect ordinary inflation in the cost of labor, parts, fuel, and overhead and are deemed by the parties to be anticipated and routine. Because these adjustments are pre-agreed in this Section 1.4, no separate advance notice of such inflationary adjustments is required, and the adjusted fee will apply automatically at the next Renewal Term and will appear on your billing statement. TMI will make the current fee schedule available on request and on tmiservices.net/thp-membership-agreement.

1.5  Other Fee Changes. Any Membership Fee change that exceeds the inflationary adjustment described in Section 1.4 will be communicated to you at least thirty (30) days before it takes effect, by email, billing statement insert, text message, or U.S. mail to the most recent contact information we have on file, any of which constitutes sufficient notice.

2. Billing, Auto-Pay & Payment Terms

2.1  Auto-Pay Authorization. By enrolling on monthly billing, you authorize TMI to charge the payment method on file for the Membership Fee and any optional add-ons each month on or about the monthly anniversary of your Start Date, continuing automatically through the Initial Term and every Renewal Term, until cancellation under Section 11.

2.2  Annual Prepayment. If you select annual prepayment, the full annual Membership Fee is due and payable at the start of each term. Annual prepayment will auto-renew on the anniversary of your Start Date using the payment method on file, unless you cancel under Section 11 at least fourteen (14) days before that anniversary.

2.3  Updated Payment Information. You are responsible for keeping current payment information on file. If a charge is declined, you authorize TMI to retry the charge up to three (3) times and to update expired card information through automatic account updater services offered by your card network.

2.4  Late Payment & Suspension. If payment is not received within fifteen (15) days of the due date, TMI may suspend Included Services and benefits until the account is current. Continued nonpayment for thirty (30) days or more may result in termination of this Agreement under Section 11.3. Termination of this Agreement for nonpayment does not release you from the full-term payment obligations set out in Section 11.2, and all amounts owed under Section 11.2 remain due and collectible following any such termination.

2.5  Administrative Fees. TMI may charge reasonable administrative fees for: (a) returned payments (not to exceed $35); (b) reinstatement of a lapsed membership (not to exceed $75); (c) processing of cancellation requests under Section 11 (not to exceed the lesser of 10% of the annual Membership Fee or $50); and (d) a non-auto-pay processing fee of $5 per month (or $50 per year on annual prepay) applied to any Member who pays the Membership Fee by check, money order, or other non-auto-pay method. The non-auto-pay processing fee reflects the additional administrative cost of manual billing and is waived for Members enrolled in auto-pay (credit card, debit card, or ACH bank draft). Service fees and add-on charges are separate from the Membership Fee.

3. What Your Total Home Protection Membership Includes

Your Total Home Protection™ membership includes the following benefits, described in detail on Schedule A:

  • Annual combined furnace and central A/C tune-up
  • Annual water heater cleaning and safety inspection
  • Annual whole-house plumbing inspection
  • Priority scheduling ahead of non-members. TMI will make commercially reasonable efforts to initiate service on the same day or next business day for qualifying situations, subject to technician and parts availability
  • Guaranteed service initiation within forty-eight (48) business hours of member notice during normal business hours, Monday through Friday, 8:00 a.m. to 4:30 p.m. “Service initiation” means TMI has acknowledged the request, assigned it to a technician or dispatch queue, and scheduled the next available appointment — it does not guarantee that on-site work will be completed within 48 hours. The 48-hour initiation standard applies to work performed directly by TMI; service initiation on electrical claims and other third-party-vendor work depends on vendor availability
  • $0 service/diagnostic fee on Included Repairs during normal business hours; reduced $49 member rate on non-covered work during normal business hours; reduced $129 after-hours service fee; reduced $229 holiday service fee (see Section 5)
  • Member pricing of twenty percent (20%) off labor on non-covered work performed directly by TMI technicians, up to a maximum discount of $500 per job. The member discount does not apply to work performed by third-party vendors, subcontractors, or specialty trades whose pricing is set by the vendor (see Section 5.3)
  • Parts and labor benefit up to $4,000 per item, per occurrence, and $12,000 per membership year, aggregate
  • $400 replacement credit if a covered appliance is determined by TMI to be beyond economical repair (see Section 8)
  • Seasonal maintenance reminders and a dedicated member service line
  • Transferability to a new owner of the Service Address, subject to Section 12

4. How to Request Service from TMI

To request service, call TMI at (563) 344-4229. TMI's phone line is answered by a live representative day or night. During normal business hours (Monday through Friday, 8:00 a.m. to 4:30 p.m.), calls are handled directly by TMI staff. Outside normal business hours, calls are answered by TMI's authorized answering service, which collects the member's information and routes the request. Emergencies are handled under Section 4.3.

4.1  Diagnosis. A licensed TMI technician will inspect the issue on-site and determine whether the failure is an Included Repair under Schedule A.

4.2  Approval. TMI will determine, in its reasonable discretion, whether the issue is covered and will select the repair method, parts source, and whether to repair or replace any component.

4.3  Emergencies. TMI determines what constitutes an emergency and will make reasonable efforts to expedite emergency service. After-hours service is billed under Section 5.2.

4.4  Authorized Vendor. All services under this Agreement must be performed by TMI or a TMI-authorized technician or vendor. TMI will not reimburse work performed by outside vendors, except where TMI has authorized the outside work in writing in advance. Certain covered services — including all electrical work under Schedule A — are coordinated by TMI but performed by a licensed third-party vendor engaged by TMI on the member's behalf. Where TMI engages a third-party vendor, TMI will inform the member before the work is performed and will identify the vendor whose pricing is set by the vendor. The 20% member discount described in this Agreement applies only to work performed directly by TMI and does not apply to third-party vendor pricing. The parts-and-labor benefit limits in Section 6 apply to all covered work, whether performed by TMI or by a TMI-engaged third-party vendor.

4.5  Service Initiation Defined. As used in this Agreement, “service initiation” means that TMI has (a) acknowledged the member's service request, (b) assigned the request to a technician or dispatch queue, and (c) scheduled the next available appointment based on technician availability, parts availability, and workload. Service initiation is a scheduling and dispatch commitment, not a guarantee that on-site work, diagnosis, or repair will be completed within any specific timeframe. TMI will make commercially reasonable efforts to provide same-day or next-business-day on-site response for qualifying situations, but actual appointment timing depends on technician availability, weather, parts availability, and other operational factors. Emergencies are governed by Section 4.3.

5. Service Fees and Diagnostic Charges

5.1  Standard Service Fee. For Included Repairs performed during normal business hours (Monday through Friday, 8:00 a.m. to 4:30 p.m.), the service/diagnostic fee is $0.

5.2  After-Hours Service Fee. For any work performed by TMI outside normal business hours, including evenings and weekends (but excluding Holidays, which are governed by Section 5.4) — whether the work is an Included Repair or non-covered work — a flat after-hours service fee of $129 applies in addition to any standard labor or parts charges. The after-hours service fee is charged per dispatch, per occurrence, and is separate from the Membership Fee.

5.3  Non-Covered Work. The $0 service/diagnostic fee described in Section 5.1 applies only to Included Repairs. For work performed directly by TMI that is not an Included Repair (including services on items excluded under Schedule C), a service/diagnostic fee of $49 applies during normal business hours. After-hours non-covered work is governed by Section 5.2 and is subject to the $129 after-hours service fee. You will also receive a twenty percent (20%) member discount on labor for such non-covered work, up to a maximum discount of $500 per job. This Section 5.3 applies only to work performed directly by TMI. It does not apply to work performed by third-party vendors, including specialty electrical, plumbing, or other subcontractors engaged to perform work on your behalf, whose pricing is set by the vendor.

5.4  Holiday Service Fee. For any work performed by TMI on a Holiday, a flat holiday service fee of $229 applies in addition to any standard labor or parts charges, in lieu of (and not in addition to) the after-hours service fee in Section 5.2. The holiday service fee applies whether the work is an Included Repair or non-covered work and applies regardless of the time of day on which the work is performed. The holiday service fee is charged per dispatch, per occurrence, and is separate from the Membership Fee. For purposes of this Section 5.4, “Holiday” means any day observed by TMI as a holiday on which TMI's offices are closed. TMI will communicate the holiday service fee at the time of dispatch when applicable, and the member's request for service after such notice constitutes acceptance of the holiday service fee.

6. Coverage Limits and Benefit Caps

  • Per-item, per-occurrence limit: $4,000
  • Annual aggregate limit per membership year: $12,000
  • Per-system claim limit: two (2) Included Repairs per covered system or appliance per membership year. A “system or appliance” means each individual furnace, A/C, heat pump, water heater, refrigerator, dishwasher, range/oven, clothes washer, or clothes dryer. Additional repair visits on the same system after the second claim are billed at standard member rates, less the member discount.
  • Heat exchanger sub-limit: one (1) heat exchanger repair or replacement per covered furnace for the life of the membership. Heat exchanger coverage applies only to furnaces less than fifteen (15) years of age (see Schedule A).
  • Compressor sub-limit: one (1) compressor repair or replacement per covered air conditioning system or heat pump for the life of the membership. Compressor coverage applies only to air conditioning systems and heat pumps less than fifteen (15) years of age (see Schedule A).
  • Replacement credit: up to $400 per covered appliance, per membership year
  • Member discount cap on non-covered work performed directly by TMI: $500 per job. The discount does not apply to work performed by third-party vendors or subcontractors (see Section 5.3)

Once a benefit limit is reached during a membership year, additional work is billed at standard member rates, less your discount. Annual aggregate and per-item limits reset at the start of each Renewal Term. The heat exchanger and compressor sub-limits in Section 6 do not reset at renewal.

7. Member Maintenance Responsibilities

Because Total Home Protection™ is a maintenance-first membership, you agree to:

  • Allow TMI to perform the included annual services (combined HVAC tune-up, water heater cleaning and safety inspection, whole-house plumbing inspection) on reasonable notice and at reasonable times
  • Replace HVAC and appliance filters at manufacturer-recommended intervals
  • Promptly report any malfunction, leak, or abnormal operation
  • Refrain from modifying, servicing, or allowing any unauthorized party to service any item listed on Schedule A

Failure to complete a scheduled annual service within the membership year, or to permit TMI reasonable access to perform it, may suspend parts and labor benefits on the affected system until the service is completed. Scheduled maintenance services are a benefit included in the Membership Fee and have no cash value if not used within the membership year.

8. Repair, Replacement, and Appliance Replacement Credit

When an Included Repair is approved, TMI will, at its sole discretion, repair or replace the covered component. If TMI determines that a covered major appliance (refrigerator, dishwasher, range/oven, clothes washer, or clothes dryer) is beyond economical repair, TMI will issue a replacement credit of up to $400 toward a comparable appliance. The member is responsible for purchasing, delivering, and installing the replacement appliance. TMI is not responsible for matching color, brand, dimensions, or connections. Any manufacturer rebates, promotional incentives, or assignable warranties arising from parts, equipment, or replacement work furnished by TMI or its authorized vendors remain the property of TMI.

9. Access & Member Cooperation

You agree to provide TMI reasonable access to the Service Address to perform services under this Agreement. You agree to reimburse TMI for any expenses, including trip charges, incurred due to missed appointments or failure to provide access. You are responsible for protecting against further damage from the time a malfunction is discovered until TMI is able to arrive.

10. Home Eligibility and Initial Condition Requirements

  • The Service Address must be a single-family residence, condominium, or townhouse up to four thousand (4,000) square feet, located within TMI's service area in the Quad Cities region, including Bettendorf, Davenport, LeClaire, and Eldridge in Iowa, and Moline, Rock Island, East Moline, Silvis, and Milan in Illinois. Properties outside the standard service area may be eligible on a case-by-case basis.
  • The membership covers up to two (2) heating systems and two (2) air-conditioning systems, each with a capacity not exceeding five (5) tons. Additional systems may be added under Schedule B.
  • All systems and components must be in normal operating condition at the Start Date.
  • Mobile homes, manufactured homes, commercial properties, short-term rentals, boarding houses, dormitories, and cooperative residences are not eligible.
  • Systems that serve any commercial space, even if they also serve a covered residence, are not eligible.

10.1  Initial Condition Inspection. TMI may, at its option, perform an initial walk-through inspection prior to the Start Date or defer the inspection to the first scheduled service or maintenance visit. TMI is not required to perform an initial walk-through to activate the membership. If, at the first service or maintenance visit, a TMI technician determines that any covered system or appliance was not in normal operating condition on the Start Date, that specific system or appliance is excluded from coverage under this Agreement until it has been restored to normal operating condition at the Member’s expense and inspected and approved by TMI. Exclusion of an individual system under this Section does not affect coverage of other systems or appliances.

10.2  Member Representations. By enrolling, you represent that, to the best of your knowledge, all covered systems and appliances at the Service Address are in normal operating condition on the Start Date. You agree to promptly disclose any known defect, malfunction, or abnormal condition. A material misrepresentation under this Section is grounds for termination under Section 11.3.

11. Cancellation

11.1  Cooling-Off Period. You may cancel this Agreement within fourteen (14) days of the Start Date for a full refund, provided no service has been requested or performed under this Agreement. This cooling-off period applies only to the Initial Term and does not apply to any Renewal Term. After the cooling-off period, the full-term obligations in Section 11.2 apply and no refunds or pro-ration are available.

11.2  Member Cancellation During the Initial Term or a Renewal Term. You agree that the annual Membership Fee is fully earned by TMI upon the start of each term. The Membership Fee funds TMI's obligation to maintain, service, and cover your home's systems and appliances over the full 12-month term, and is not refundable or pro-rated after the cooling-off window described in Section 11.1. If you cancel this Agreement after the cooling-off window for any reason — including but not limited to sale of the Service Address, relocation, dissatisfaction, or any other cause — you remain obligated to pay the full annual Membership Fee for the current term in which you cancel. TMI will not refund any Membership Fees already paid during that term. If you are on monthly billing, the unpaid balance of the annual Membership Fee is immediately due upon cancellation.

11.2.1  Same Obligation Applies to Renewal Terms. Each Renewal Term is a new 12-month commitment on the same terms. Once any Renewal Term begins under Section 1.3, you are obligated to pay the full annual Membership Fee for that term. To avoid a new Renewal Term commitment, you must opt out of auto-renewal under Section 11.4 at least fourteen (14) days before the end of the then-current term.

11.2.2  Consequences of Nonpayment. If you cancel without paying the full annual Membership Fee owed for the current term, or if you dispute, reverse, or charge back any Membership Fee payment, you agree that TMI may recover from you: (a) the full unpaid balance of the annual Membership Fee for the current term; (b) the retail value of all services, parts, labor, replacement credits, tune-ups, and other benefits TMI has provided to you during that term, valued at TMI’s standard retail rates in effect at the time the services were performed, without application of any member discount, and TMI’s reasonable determination of those rates shall govern; (c) reasonable costs of collection, including collection agency fees and court costs; and (d) reasonable attorneys’ fees to the extent permitted by applicable law. Amounts under this Section 11.2.2 are cumulative and are in addition to, not in lieu of, the obligations in Sections 11.2 and 11.2.1.

11.2.3  Administrative Fee. A reasonable administrative fee not to exceed the lesser of 10% of the annual Membership Fee or $50 applies to all member-initiated cancellations.

11.3  TMI Cancellation. TMI may cancel this Agreement at any time upon fifteen (15) days’ written notice to the most recent email or mailing address on file. Prior notice is not required where cancellation is for nonpayment, material misrepresentation, abuse of member benefits, or substantial breach of this Agreement. Where TMI cancels this Agreement for reasons other than nonpayment, material misrepresentation, abuse of member benefits, malicious acts by the Member, or substantial breach of this Agreement by the Member, TMI will refund unearned Membership Fees on a pro-rata basis. No refund is due where TMI’s cancellation is based on any of the foregoing Member-fault reasons. TMI’s cancellation under this Section 11.3 does not release the Member from the obligations in Sections 11.2, 11.2.1, and 11.2.2, which remain in full force.

11.4  Opting Out of Auto-Renewal. You may opt out of auto-renewal at any time during the then-current term, provided you notify TMI by calling (563) 344-4229 at least fourteen (14) days before the end of that term. Opting out of auto-renewal under this Section 11.4 is the only way to end your membership at the natural end of a term without incurring the full-term obligations described in Section 11.2. Opting out ends the membership at the natural end of the then-current term and does not entitle you to a refund of prepaid fees for that term. If you opt out after the fourteen (14) day window, the next Renewal Term will begin automatically and you will be obligated under Section 11.2 for that Renewal Term.

11.5  TMI Determination. TMI’s reasonable determination that a Member’s conduct constitutes abuse of member benefits, malicious acts, or substantial breach of this Agreement shall govern for purposes of this Agreement, subject to applicable law.

12. Transferring Your Membership When You Sell Your Home

If you sell the Service Address during an active term, this Agreement may be transferred to the new homeowner for the remainder of the then-current term at no additional cost, provided (a) you notify TMI in writing within thirty (30) days of closing, (b) the new homeowner accepts this Agreement in writing, and (c) all Membership Fees are current. Upon transfer, the new homeowner becomes the Member and this Agreement auto-renews under Section 1.3 thereafter.

13. Communications & Electronic Notices

You consent to receive communications from TMI — including service reminders, appointment confirmations, billing notices, fee changes permitted under Section 1.5, and other membership-related notices — by email, text message, phone, or U.S. mail to the most recent contact information on file. Any such communication is deemed delivered on the date sent. You are responsible for keeping your contact information current. Communications required or permitted under this Agreement may be delivered by any of these channels at TMI’s option, and TMI is not required to use multiple channels for the same notice.

Standard message and data rates may apply to text messages. You may opt out of marketing communications at any time; opting out of transactional or service-related communications is not available while the membership is active.

14. Limitations of Liability; Disclaimer of Warranties

14.1  Work Warranty. Repairs or replacements performed under this Agreement are warranted for a period of thirty (30) days on parts and labor, or the manufacturer’s warranty period, whichever is longer, to the extent assignable to you.

14.2  No Other Warranties. EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, TMI MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

14.3  Consequential Damages. TMI is not liable for consequential, incidental, or indirect damages, including loss of use, property damage, personal injury, food spoilage, inconvenience, lost wages, or lodging expenses. TMI is not liable for delays caused by parts unavailability, weather, labor difficulties, or events outside TMI’s reasonable control.

14.4  Total Liability Cap. TMI’s total liability under this Agreement for any membership year is capped at the annual aggregate benefit limit set out in Section 6.

15. Other Insurance, Warranties & Guarantees

If any loss otherwise eligible under this Agreement is covered by insurance, a manufacturer’s warranty, a builder’s warranty, or any other collectible guarantee, the benefit under this Agreement is secondary and will not apply until other coverage is exhausted. You agree to cooperate in good faith in identifying and pursuing any other available coverage.

16. General Terms

16.1  Entire Agreement. This Agreement, including Schedules A, B, and C, is the entire agreement between you and TMI and supersedes all prior representations, warranties, or agreements. Promotional materials, flyers, and marketing communications are descriptive only and do not modify the terms of this Agreement.

16.2  Modifications by TMI. TMI may update Schedules A, B, and C, the list of excluded items, procedural requirements, and non-fee operational terms from time to time. Updates are effective at the start of the next Renewal Term and will be posted on tmiservices.net/thp-membership-agreement. Your continued membership constitutes acceptance of the updated terms.

16.3  Governing Law. This Agreement is governed by the laws of the State of Iowa, without regard to conflict of laws principles. Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in Scott County, Iowa.

16.4  Severability. If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect.

16.5  Assignment by TMI. TMI may assign this Agreement to any successor entity or affiliate without notice. You may not assign this Agreement except as permitted under Section 12.

16.6  Force Majeure. TMI is not liable for delays or failures to perform caused by events beyond its reasonable control, including weather, labor shortages, supply chain disruptions, pandemics, or governmental action.

16.7  Regulatory Note. This Agreement is a service and maintenance membership program providing scheduled maintenance services, priority service access, member pricing, and limited parts and labor benefits as described herein. The parties acknowledge and agree that this Agreement is not a policy of insurance under Iowa Code Chapter 515 or 523C or any corresponding statute of another state, and is not a home warranty, service contract, or residential service contract under Iowa Code Chapter 523C, 215 ILCS 5/352, or any similar statute of another state. TMI’s obligations under this Agreement are backed by the full faith and credit of TMI.

16.8  Current Version of Agreement. The current version of this Agreement, as well as any updates to Schedules A, B, and C and any other operational terms permitted under Section 16.2, will be published and maintained at tmiservices.net/thp-membership-agreement (or such other URL designated by TMI from time to time). The version of the Agreement published at that URL on the date of the Member's enrollment, or on the start of any Renewal Term, controls the Member's coverage for that term. Members are encouraged to review the current published version periodically. A printed or electronic copy of the Agreement in effect at the time of enrollment will be provided to the Member upon request.

17. Member Acknowledgment

 By signing below, enrolling online or by phone, or by making your first Membership Fee payment, you acknowledge that you have read this Agreement in full and agree to all of its terms. You specifically acknowledge and agree to: the full-term payment obligations in Section 11.2, under which you are obligated to pay the full annual Membership Fee for the current term regardless of when you cancel and regardless of the reason; the automatic renewal provision in Section 1.3; and the auto-pay authorization in Section 2.1.

Schedule A — Included Services & Repairs

What Total Home Protection covers: annual maintenance, HVAC, plumbing, electrical, water heater, and major appliance repairs.

Annual Maintenance Services (Included)

  • Combined furnace and central A/C tune-up — performed in a single visit, both systems serviced together
  • Water heater cleaning and safety inspection — exterior cleaning, visual inspection of the tank, burner assembly, venting, supply lines, gas connections, and relief valve, plus operational testing. Full tank flush is not included by default; flushing may be performed at the technician's discretion if the unit is suitable for service, or at the member's request subject to a separate liability waiver
  • Whole-house plumbing inspection, including accessible shut-offs, supply lines, visible drains, water heater connections, and sump pump operation
  • Member service line, seasonal reminders, and priority scheduling

Included Repairs — Heating & Air Conditioning

Parts and labor coverage on operational failure of the following systems and components, limited to two (2) primary heating systems and two (2) primary air conditioning systems (capacity not exceeding 5 tons each). Additional systems may be added under Schedule B.

  • Central air conditioning systems using ductwork for air distribution
  • Evaporator cooler units, condensers, compressors, and air handlers
  • Condenser fan motors and blower fan motors
  • Accessible interior refrigerant gas lines
  • Heat pumps (covered at the same level as A/C systems)
  • Thermostats
  • Hot water, steam, and warm-air heating systems
  • Gravity furnaces — repair only, and only when parts are available. Gravity furnace replacement is not included
  • Heat exchangers on furnaces less than fifteen (15) years of age, limited to one (1) heat exchanger repair or replacement per covered furnace for the life of the membership (see Section 6)
  • Compressors on air conditioning systems and heat pumps less than fifteen (15) years of age, limited to one (1) compressor repair or replacement per covered system for the life of the membership (see Section 6)

Service on heating and air conditioning equipment is scheduled Monday through Friday, 8:00 a.m. to 4:30 p.m. After-hours service is available at the $129 after-hours service fee described in Section 5.2. Service on TMI-observed Holidays is subject to the $229 holiday service fee in Section 5.4.

Included Repairs — Plumbing (within the perimeter of the main foundation)

  • Water, gas, and vent lines within the perimeter of the main foundation
  • Water supply line to the ice maker (the ice maker itself is excluded)
  • Drain, waste, and vent lines within the perimeter of the main foundation
  • Washing machine outlet and stand-up pipe
  • Permanently installed sump pump used only to pump water
  • Drain and sewer stoppages within the perimeter of the main foundation
  • Faucets
  • Shower and tub valves
  • Water heater, including gas valve, heating element, thermostat, anode rod, pilot assembly, thermocouple, relief valve, drain valve, and standard operational components
  • Toilet tanks, bowls, lids, and toilet mechanisms within the toilet tanks

Stoppages Waiting Period: Drain and sewer stoppage claims are not covered during the first thirty (30) days of the Initial Term. This waiting period does not apply to Renewal Terms or to other plumbing components.

Included Repairs — Electrical

  • General wiring, components, and parts within the perimeter of the main foundation and the primary garage
  • Fuse box and standard circuit breaker panels
  • Circuit breakers
  • Receptacles
  • Ceiling fans and bathroom exhaust fans (whole home — motors and switches; light bulbs, blades, globes, and decorative components excluded)
  • Garage door openers (motor only — remotes, keypads, sending units, and springs are excluded)

Electrical work under this Agreement is coordinated and dispatched by TMI but performed by a licensed third-party electrician engaged by TMI on the member's behalf. TMI will arrange scheduling, communicate with the vendor, and apply the parts-and-labor benefit (subject to the per-item, per-occurrence, and annual aggregate limits in Section 6) toward the vendor's invoice for covered electrical repairs. The 20% member discount described in this Agreement applies to work performed directly by TMI and does not apply to the third-party electrician's pricing (see Sections 4.4 and 5.3). Service initiation timing on electrical claims is subject to vendor availability and may not meet the 48-hour initiation standard in Section 3.

Federal Pacific Stab-Lok and similar panels are excluded in full under Schedule C.

Included Repairs — Major Appliances

Operational failure of primary appliances less than twelve (12) years of age:

  • Primary stove, range, and oven
  • Primary refrigerator, including the water supply line to the ice maker (ice maker itself excluded)
  • Primary built-in dishwasher, including the dishwasher soap dispenser
  • Garbage disposal
  • Primary clothes washer
  • Primary clothes dryer

Stackable washer/dryer units: when replacement is required, the replacement allowance applies to the defective unit only, unless both are defective and must be replaced.

Member Benefits

  • $0 service/diagnostic fee on Included Repairs during normal business hours
  • $49 service/diagnostic fee on non-covered work performed by TMI during normal business hours (Section 5.3)
  • $129 flat after-hours service fee for any work performed outside normal business hours (Section 5.2)
  • $229 flat holiday service fee for any work performed on TMI-observed Holidays (Section 5.4)
  • 20% member discount on labor for non-covered repairs performed directly by TMI, up to $500 per job. Discount does not apply to work performed by third-party vendors or subcontractors whose pricing is set by the vendor (see Section 5.3)
  • Priority scheduling ahead of non-members; commercially reasonable efforts to provide same-day or next-business-day response for qualifying situations (see Section 4.5)
  • Guaranteed service initiation within 48 business hours during normal business hours — TMI will acknowledge, assign, and schedule the next available appointment (see Section 4.5 for definition)
  • Up to $400 replacement credit per covered appliance, per membership year (see Section 8)
  • Transferable to a new homeowner of the Service Address under Section 12

B.1 General Add-On Terms

B.1.1  Coverage Scope. Each add-on extends parts and labor coverage to the specific equipment identified at the time of enrollment. Coverage is for operational repair only. Full system or equipment replacement is not included under any add-on, except where expressly stated below. All add-on coverage is subject to the per-item, per-occurrence, and annual aggregate limits set out in Section 6, and to all exclusions in Schedule C.

B.1.2  Equipment Age. Add-on coverage applies only to equipment less than twelve (12) years of age on the Start Date of the add-on, unless a different age limit is specified below. Equipment that exceeds the age limit during the membership term remains covered for the remainder of that term but will not be covered upon renewal.

B.1.3  Initial Condition. Add-on equipment must be in normal operating condition on the Start Date of the add-on. The initial-condition provisions in Section 10.1 apply to all add-on equipment.

B.1.4  Waiting Period. A thirty (30) day waiting period applies to all add-on coverage from the Start Date of the add-on. Claims arising during this period are not covered. The waiting period does not apply to add-ons that have been continuously in force for at least one (1) renewal cycle.

B.1.5  No Replacement Credit. The $400 appliance replacement credit described in Section 8 applies only to the major appliances listed in Schedule A and does not apply to add-on equipment, except where expressly stated below.

B.1.6  Member-Supplied Equipment. Add-on coverage applies only to equipment professionally installed and in good working order. Equipment installed by the member, by an unlicensed party, or in violation of manufacturer specifications or local code is not covered.

B.1.7  Add-On Term and Cancellation. Each add-on creates a binding twelve (12) month coverage commitment beginning on the Add-On Start Date. Add-ons added mid-term are pro-rated through the end of the then-current base membership term, after which the add-on automatically renews together with the base membership under Section 1.3, unless cancelled under Section 11.4. Add-ons cannot be removed mid-term and are subject to the same full-term payment obligations as the base membership under Section 11.2. The twelve (12) month minimum commitment in this Section B.1.7 runs from the Add-On Start Date and may extend across a base membership renewal; the clawback in Section B.1.8 applies until the Member has completed twelve (12) full months of paid add-on coverage.

B.1.8  Add-On Benefit Clawback. If the Member files one or more add-on claims and subsequently cancels the base membership, terminates the add-on, or fails to renew before completing twelve (12) full months of paid add-on coverage from the Add-On Start Date, TMI may recover from the Member the retail value of all parts, labor, and other benefits provided under the add-on during that period, valued at TMI's standard retail rates in effect at the time the services were performed, less the total add-on fees actually paid by the Member. TMI's reasonable determination of those retail rates shall govern. Amounts recoverable under this Section B.1.8 are in addition to any amounts owed under Sections 11.2 and 11.2.2 and are cumulative.

B.2 Add-On-Specific Terms

B.2.1  Additional A/C or Furnace System (beyond 2). Each unit must be less than fifteen (15) years of age and have a capacity not exceeding five (5) tons. This add-on includes (a) annual tune-up of the additional unit, performed in the same scope and manner as the primary HVAC tune-up described in Schedule A, and (b) parts and labor coverage on operational failure. Coverage mirrors the HVAC coverage in Schedule A and is subject to the same heat exchanger and compressor sub-limits in Section 6. Each instance of this add-on covers one (1) additional unit; multiple additional units may be covered by adding multiple instances.

B.2.2  Heat Pump Upgrade. This add-on substitutes heat pump coverage for the standard A/C coverage in Schedule A. The premium reflects the higher repair cost of heat pumps and the more involved annual tune-up (refrigerant pressure check, defrost cycle test, reversing valve inspection, and other heat-pump-specific service items). This add-on includes (a) annual heat pump tune-up performed in the place of the standard A/C portion of the primary HVAC tune-up, and (b) parts and labor coverage on operational failure. Heat pumps are subject to the same age limit and compressor sub-limit as A/C systems described in Schedule A and Section 6.

B.2.3  Mini-Split System. Coverage applies to each individual mini-split unit identified at enrollment. Compressor sub-limit in Section 6 applies. Outdoor units must be installed in a manner that protects against weather and physical damage; weather and impact damage are excluded under Schedule C.

B.2.4  Water Filtration Equipment. Coverage applies to operational repair only of the equipment identified at enrollment. Full equipment replacement is not included. If the equipment is determined by TMI to be beyond economical repair, the add-on benefit terminates with respect to that equipment and no replacement credit is owed. The following are not covered: salt, filters, cartridges, resin beds, membranes, UV bulbs, brine tanks, control valves more than ten (10) years of age, and any consumable, expendable, or wear components. Rental equipment is not covered.

B.2.5  Well Water Pump. Coverage applies to operational repair only of the pump motor and pump components, plus accessible above-ground wiring and pressure switch. Full pump replacement is not included. The following are not covered: well drilling, well casing, well screen, pitless adapters, pressure tanks, water lines below grade, pump pulling labor (beyond a single pull per membership year), and any work requiring excavation or specialized well equipment. If the pump is determined beyond economical repair, the add-on benefit terminates and no replacement credit is owed.

B.2.6  Additional Refrigerator. Coverage applies to one (1) additional refrigerator beyond the primary refrigerator covered under Schedule A. The additional refrigerator is subject to the same twelve (12) year age limit and the same exclusions as the primary refrigerator. The $400 replacement credit in Section 8 does apply to the additional refrigerator, subject to one (1) replacement credit per refrigerator per membership year.

B.2.7  Additional Water Heater — Tank or Tankless (per unit). Coverage applies to one (1) additional residential water heater (gas or electric tank-type, or tankless) beyond the primary water heater covered under Schedule A. Each additional water heater requires its own instance of this add-on; multiple additional water heaters may be covered by adding multiple instances.

Included Services and Coverage. This add-on includes (a) annual cleaning and safety inspection of the additional water heater, performed in the same scope and manner as the primary water heater service described in Schedule A, and (b) parts and labor coverage on operational failure of standard components, including (for tank units) gas valve, heating element, thermostat, anode rod, pilot assembly, thermocouple, relief valve, drain valve, and standard operational components, and (for tankless units) gas valve, control board, flow sensor, igniter, heat exchanger, relief valve, and standard tankless operational components.

Not Included. Full water heater replacement is not included under this add-on. If the additional water heater is determined by TMI to be beyond economical repair, the add-on benefit terminates with respect to that unit and no replacement credit is owed. Commercial water heaters, point-of-use water heaters, recirculation systems, expansion tanks, exterior venting beyond the unit, water-quality damage, scale or mineral damage where regular descaling has not been performed, freeze damage, and equipment installed in violation of manufacturer specifications or local code are not covered under this add-on.

Age Limit. The additional water heater must be less than twelve (12) years of age on the Start Date of the add-on. The general add-on terms in Section B.1 apply.

Member Maintenance for Tankless Units. Tankless water heaters require regular descaling to operate properly. Members with tankless add-on coverage agree to maintain regular descaling at manufacturer-recommended intervals (typically every 12-24 months depending on water hardness). Failure of a tankless unit attributable to lack of descaling or to mineral/scale buildup is not covered. TMI can perform descaling as a separately-billed service at standard member rates.

Schedule C — What Is Not Included

Excluded items, conditions, and residence types not covered by Total Home Protection.

The items below are not Included Repairs under this Agreement. The list is representative and is not exhaustive. Anything not specifically listed as included on Schedule A is not covered, regardless of whether it appears in this list.

Excluded Items & Components

  • Built-in trash compactors, built-in microwaves, central vacuums, range hoods, doorbells and chimes, attic fans, whole-house fans, secondary freezers, rotisserie and meat probes, and food spoilage
  • Ice makers (the water line to the ice maker is covered; the ice maker itself is not)
  • Ceiling fan and bathroom exhaust fan components not covered under Schedule A, including light bulbs, blades, globes, pull chains, and decorative components
  • Garage door opener remotes, keypads, sending units, and springs
  • Septic systems, including septic tanks, drain fields, lift stations, and all related components
  • Well water pumps, water filtration equipment (water softeners, water purifiers, filters, resin beds, ion-exchange systems), additional water heaters (tank or tankless) — available as optional add-ons under Schedule B
  • Commercial water heaters, point-of-use water heaters, recirculation systems, expansion tanks, and exterior venting beyond a water heater unit
  • Lawn sprinkler systems, pools, spas, hot tubs, Jacuzzis, and whirlpools
  • Geothermal heating and cooling, solar systems, zone systems, glycol systems, humidifiers, dehumidifiers
  • Ductwork, chimneys, flue pipes, vent lines, fuel storage tanks, and exterior piping
  • Window, wall, portable, and gas air conditioners; electric heat; space heaters; fireplaces
  • Plumbing or wiring outside the perimeter of the main foundation, under the slab, or exterior to the residence
  • Appliances twelve (12) years of age or older
  • Heat exchangers on furnaces fifteen (15) years of age or older, and any second heat exchanger claim on a covered furnace
  • Compressors on air conditioning systems or heat pumps fifteen (15) years of age or older, and any second compressor claim on a covered system

Federal Pacific electrical panels:  Federal Pacific Stab-Lok and similar panels are excluded in full. TMI does not perform electrical work directly; replacement is available through a third-party electrician at standard vendor rates. The member discount does not apply to vendor pricing (see Section 5.3).

Excluded Conditions & Causes

  • Pre-existing conditions, items not in normal operating condition at the Start Date, or conditions known to you but not disclosed
  • Damage caused by abuse, negligence, improper use, unauthorized service, improper installation, or code violations
  • Damage from rust, corrosion, sediment, mineral deposits, freezing, weather, water back-up, or pest infestation
  • Damage from fire, flood, smoke, lightning, wind, hail, earthquake, theft, vandalism, accident, acts of aggression, or acts of God
  • Power surges, outages, utility interruptions, or failures of third-party service providers
  • Cosmetic items and repairs: dents, scratches, knobs, handles, shelves, racks, door seals and gaskets, light bulbs, filters, caulking, grouting
  • Refrigerant gas itself, refrigerant leaks, leak searches, exterior refrigerant lines, and asbestos or toxic-material handling
  • Consequential damages, including food spoilage, lodging, loss of use, property damage, personal injury, or lost wages
  • Repairs to walls, floors, ceilings, cabinets, countertops, tile, tubs, sinks, or any finished surfaces required to access a covered component
  • Permits, code upgrades, and any repair or replacement cost attributable to bringing a system into compliance with current code
  • Drain and sewer stoppages arising in the first thirty (30) days of the Initial Term (see Schedule A)

Excluded Residences

  • Mobile homes, manufactured homes, commercial properties, short-term rentals, boarding houses, dormitories, and cooperative residences
  • Systems serving commercial space, even when that space is adjacent to a covered residence
  • Residences over 4,000 square feet (custom pricing available on request)
  • More than two (2) primary heating systems or two (2) primary A/C systems (additional systems covered under Schedule B)
